    <title>Michigan House Passes “Ban on Bans” Bill Protecting Gas &amp; Propane in Homes</title>

    <description>The Michigan House of Representatives approved bipartisan legislation, House Bill 4486, that would prevent local governments from banning natural gas or propane appliances, including stoves, water heaters, and furnaces. The bill would also prohibit local restrictions on the installation of natural gas and propane infrastructure. The measure passed 61&amp;ndash;42 on December 17, with all Republicans present and four Democrats voting in favor.

Supporters, led by Rep. Steve Frisbie, R&amp;ndash;Battle Creek, described the bill as a consumer affordability and energy choice measure. They said natural gas is typically less expensive than electricity for home energy use and that residents should not face higher costs due to local ordinances. The bill has been carried over into the 2026 legislative session, and it is unclear whether the Michigan Senate will consider the legislation. HPBA will continue to monitor developments.

In related federal activity, the Federal Energy Choice Act now has 150 cosponsors. The legislation was approved by the U.S. House Energy &amp;amp; Commerce Committee on December 3 and is awaiting consideration by the full House. The bipartisan bill would prohibit state and local governments from restricting access to specific energy sources, including natural gas.

Why It Matters to Members
This legislation could affect member companies involved in the manufacturing, distribution, installation, and servicing of natural gas and propane appliances by limiting local restrictions on products and infrastructure used in residential construction and home energy systems.

    <description>The Southeast Hearth, Patio &amp;amp; Barbecue Association (SEHPBA) has selected Eric Hash, CAE as Executive Director. &amp;nbsp;

Hash was the unanimous choice of the SEHPBA screening committee. &amp;ldquo;Eric stood out as a well-qualified candidate who has the association and board leadership experience that will take SEHPBA into the future and build on our strong legacy,&amp;rdquo; said Tom Parks, Vice President at Large of the SEHPBA Board of Directors and VP and General Manager at COASTROAD Hearth &amp;amp; Patio.

Hash holds the Certified Association Executive (CAE) designation, a Master&amp;rsquo;s in Management and Leadership from Liberty University, a Bachelor&amp;rsquo;s in Bible Studies from Johnson University, and additional certifications in Board Development and Nonprofit Management from Duke University. &amp;nbsp;

At the core of his life is his family and his favorite sport, soccer. He lives in Virginia with his wife, Kim, and their two sons.

SEHPBA welcomes Hash to this leadership role and looks forward to the continued growth and support of member companies throughout the region.

After more than a decade of service as Executive Director of the Southeast Hearth, Patio &amp;amp; Barbecue Association (SEHPBA), Cindy Wise retired in December 2025. Wise has been a central figure in the region, known for her focus on education, member support, and building strong relationships throughout the hearth, barbecue, and outdoor living community. She received a Lifetime Achievement Award at HPBExpo25.

During her tenure, Wise expanded SEHPBA&amp;rsquo;s training programs, strengthened outreach to the chimney sweep community, and helped bring hands-on education directly to members across the region. Her earlier experience running a fireplace business with her husband Bob shaped her practical, people-focused approach and her commitment to helping business owners grow and succeed.

As she steps into retirement, SEHPBA and HPBA extend their sincere appreciation for her leadership and the lasting contributions she has made to the industry.

HPBA extends its condolences to Laura Litchfield, President of HPBA Canada, and her family on the passing of her husband, John Andrew Litchfield, on December 4, 2025, in Huntsville, Ontario.&amp;nbsp;

John was a devoted husband, father, and grandfather, and a respected business professional with deep roots in the Huntsville community. He built his career in business and operations management, working alongside his father at Aquacare, where he served as General Manager for many years, before spending 14 years with Huntsville Honda as Fixed Operations Manager. John was also actively involved in local service and youth sports organizations, including the Kinsmen Club and Huntsville Minor Hockey, where he served in several leadership roles, including President.&amp;nbsp;

John is survived by Laura, their children Sarah and Thomas, and his granddaughter Lilah, along with extended family. He will be remembered for his thoughtfulness, steady presence, and commitment to his family and community.&amp;nbsp;

The State of New York has agreed to delay implementation of its All-Electric Building Code statute while legal challenges continue in the appeals court. The postponement, which will take effect once the court provides final sign-off, follows coordinated filings and requests from several trade associations, including the Northeast Hearth, Patio &amp;amp; Barbecue Association (NEHPBA).&amp;nbsp;

&amp;quot;NEHPBA exists to advocate for fair policies and to provide education and networking opportunities for the industry,&amp;rdquo; said Bob Feen, Co-Owner of HPBA member company Feens Country Living. &amp;ldquo;This development reflects months of coordinated advocacy, legal review, and member engagement by NEHPBA, HPBA, and aligned trade associations.&amp;quot;

The delay does not resolve the underlying case, but it provides additional time for the appeals process to move forward. NEHPBA&amp;rsquo;s legal team says work is ongoing as the court reviews arguments related to the statute and its potential impacts on residential construction and energy policy.&amp;nbsp;

Although the case centers on New York, the decision carries implications for stakeholders across the broader region. Energy costs, housing affordability, and implementation timelines remain key considerations for policymakers and industry groups. The pause offers an opportunity for continued analysis and discussion while the court evaluates next steps.&amp;nbsp;

HPBA and NEHPBA will continue monitoring the proceedings and providing updates as new information becomes available. For now, the temporary pause allows additional time for stakeholders to assess operational and regulatory considerations ahead of any future implementation of the All-Electric Building Code.&amp;nbsp;

    <description>The IRS has released the updated Form 5695 (Residential Energy Credits) for the 2025 tax year. Taxpayers claiming the Energy Efficient Home Improvement Credit must now include the four-character Qualified Manufacturer Identification Number (QMID) for qualifying biomass stoves.&amp;nbsp;

The QMID requirement, established in the Inflation Reduction Act to help prevent fraud across the tax credit program, requires manufacturers to apply for a QMID and make it readily accessible to distributors, dealers, and customers to ensure product eligibility.&amp;nbsp;

As a reminder, the Energy Efficient Home Improvement Credit expires on December 31, 2025, and qualifying biomass stoves must be installed before that date.&amp;nbsp;

Joseph Forshaw IV, a lifelong member and advocate of the hearth and patio industry, passed away on November 11, 2025. He began his career earlier than most in the hearth industry, growing up and working in the family business. Forshaw IV was a part of the fourth&amp;nbsp;generation of Forshaws to lead the business forward, becoming President of Forshaw in 1985. He led the retail channel of the company alongside his brother, Rick.

Forshaw IV was a keen business leader, who always led by example. After 30+ years, he retired in 2016. He is survived by his wife, Liza, their three children, and one grandson.

According to&amp;nbsp;McKinsey &amp;amp; Company, U.S. retailers are holding about&amp;nbsp;$740 billion&amp;nbsp;in excess inventory. For the&amp;nbsp;hearth, barbecue, and outdoor living industry, taking stock strategically today can support stronger margins and a smoother start to the new&amp;nbsp;year.&amp;nbsp;

&amp;ldquo;Our&amp;nbsp;industry can&amp;rsquo;t afford to approach inventory as a passive process,&amp;rdquo; said Jill McClure, President &amp;amp; CEO of the Hearth, Patio &amp;amp; Barbecue Association (HPBA). &amp;ldquo;Planning ahead is essential.&amp;nbsp;The business owners&amp;nbsp;who manage inventory in Q4 are the ones who lead in Q1.&amp;rdquo;&amp;nbsp;

1. Review what sold&amp;nbsp;and what&amp;nbsp;didn&amp;rsquo;t&amp;nbsp;

Analyze this year&amp;rsquo;s results before placing new orders. Reorder top sellers, clear slow movers, and watch for growth in categories like fire tables, pizza ovens, and outdoor heating.&amp;nbsp;

2. Be smart about early buys&amp;nbsp;

Take advantage of discounts only when they fit your cash flow and forecast. Use past sales and regional demand to&amp;nbsp;guide&amp;nbsp;how much to order.&amp;nbsp;

3. Focus on core products&amp;nbsp;

Keep high-turn, high-margin lines in stock and reduce items that tie up space or capital. A tighter mix often performs better than a full one.&amp;nbsp;

4. Turn inventory into engagement&amp;nbsp;

Alan Trusler, a longtime contributor to the hearth industry, passed away on October 8, 2025, at the age of 70.&amp;nbsp;He&amp;nbsp;began his career in the late 1970s in northeastern Washington, where he co-founded Aladdin Steel Products. Working initially out of a small shop, he and&amp;nbsp;his colleague, Dan Henry Jr.,&amp;nbsp;began fabricating stoves for the growing Cedar Creek community. In 1979,&amp;nbsp;Alan&amp;nbsp;developed what became the patented Quad-Burn system. This technology&amp;nbsp;helped establish the performance and identity of the stoves that later evolved into the Quadra-Fire line within today&amp;rsquo;s Forge &amp;amp; Flame brand family.&amp;nbsp;

As Aladdin Steel expanded,&amp;nbsp;Alan&amp;nbsp;relocated the business to Colville, Washington, in 1987 and served as its president during a period of steady growth. When the company was acquired by HON Industries in 1998,&amp;nbsp;he&amp;nbsp;remained in a leadership role and helped guide the transition as the business became part of Hearth &amp;amp; Home Technologies. His work during this period focused on maintaining local operations in Colville and&amp;nbsp;on supporting the construction of a new manufacturing facility that enabled&amp;nbsp;increased production and continued employment in the region.&amp;nbsp;

Alan&amp;nbsp;spent many years working within Hearth &amp;amp; Home Technologies and stayed engaged with the industry throughout his career. His early technical developments, business leadership, and long tenure with HHT reflect a career shaped by hands-on problem-solving and company building. He is survived by his wife, Esther, their three children, and several grandchildren.&amp;nbsp;

In Memoriam: Gary Smith





Gary Smith, who served for many years as a lobbyist for the Northwest Hearth, Patio &amp;amp; Barbecue Association in Washington State, has passed.&amp;nbsp;Gary&amp;nbsp;spent his career working on behalf of small businesses and trade associations, focusing on policy issues that affected day-to-day operations for contractors and service providers. In addition to his work with the&amp;nbsp;hearth,&amp;nbsp;barbecue, and outdoor living&amp;nbsp;sector, he served as Executive Director of the Independent Business Association and&amp;nbsp;represented&amp;nbsp;several industry groups in Olympia.&amp;nbsp;

During&amp;nbsp;more than a decade of advocacy work, Gary regularly engaged&amp;nbsp;with state agencies and lawmakers to address regulatory proposals, economic considerations,&amp;nbsp;and legislative priorities. His efforts&amp;nbsp;focused on ensuring that small and independent businesses were included in policy discussions and that their perspectives were clearly communicated to decision-makers. He&amp;nbsp;monitored&amp;nbsp;bills, provided testimony,&amp;nbsp;and offered guidance to association leaders navigating complex state processes.&amp;nbsp;

Gary&amp;rsquo;s long-running&amp;nbsp;involvement in Washington&amp;rsquo;s policy environment left a mark on the organizations he served, and his work&amp;nbsp;contributed to&amp;nbsp;efforts&amp;nbsp;to strengthen&amp;nbsp;the business climate for contractors and service professionals. He is remembered by many in the Northwest region for his years of service to the industry.&amp;nbsp;

Held in the historic Hall of Flags, the Advocacy Day featured both indoor and outdoor showcase spaces, giving legislators and their staff the opportunity to see natural gas and propane appliances, biomass stoves, electric fireplaces, and outdoor living equipment firsthand. NEHPBA provided materials on energy diversity, safety, and the importance of small businesses, ensuring that attendees left with a better understanding of the industry&amp;rsquo;s contributions.&amp;nbsp;

As a deaf employee, Danny&amp;rsquo;s presence inspired our team to grow and adapt&amp;mdash;learning sign language and implementing enhanced safety protocols to ensure an inclusive and supportive work environment.

In 2024, Danny transitioned to our stovebuilding team in Retalhuleu, where he continues to play a vital role.     <description>Uncertainty from federal and state policy changes continues to affect the hearth, barbecue, and outdoor living industry. Tariffs, shifting tax credit rules, and new regulatory requirements can complicate business planning for manufacturers, distributors, and retailers. The HPBA Government Affairs team remains focused on ensuring the industry&amp;rsquo;s voice is heard in these discussions and that members have the information they need to adapt.&amp;nbsp; Tariffs and Trade Policy&amp;nbsp; Tariffs on steel, aluminum, and imported components directly impact product costs and availability. For many manufacturers, this means adjusting supply chains and evaluating how to remain competitive. HPBA has consistently raised these concerns with policymakers, stressing the need for predictability.&amp;nbsp; HPBA continues to have conversations with lawmakers to make sure that the specific impacts on our industry are understood.&amp;nbsp; Energy Tax Credits&amp;nbsp; The&amp;nbsp;Energy Efficient Home Improvement Credit&amp;nbsp;currently allows homeowners to claim 30% of purchase and installation costs, up to $2,000 annually, for qualifying biomass stoves. This incentive is set to expire at the end of 2025. While the announced expiration is not the outcome we hoped for, HPBA will continue to explore other opportunities in support of manufacturers, retailers, and consumers who rely on this important incentive.&amp;nbsp; HPBA continues to advocate for policies that give consumers meaningful incentives to upgrade to cleaner, more efficient appliances.&amp;nbsp;&amp;nbsp; Members: HPBA has created a member-exclusive &amp;ldquo;How to Prepare for the Expiration of the Biomass Tax Credit Infosheet.&amp;rdquo; Request your copy by completing the&amp;nbsp;HPBA Biomass Tax Credit Infosheet Survey. We&amp;rsquo;ll send you the infosheet directly by email.&amp;nbsp;&amp;nbsp;&amp;nbsp; Regulatory Changes&amp;nbsp; New requirements from federal agencies, including EPA certification updates and Qualified Manufacturer numbers for tax credit eligibility, add another layer of complexity for companies. HPBA is working closely with regulators to provide clear guidance for manufacturers and ensure retailers can give accurate information to customers.&amp;nbsp; Advocacy on Behalf of the Industry&amp;nbsp; In addition to direct engagement with federal agencies and Congress, HPBA collaborates with its affiliates at the state level to track and respond to new legislative proposals. By coordinating efforts across regions, HPBA is able to share resources and strengthen the industry&amp;rsquo;s collective voice.&amp;nbsp; &amp;ldquo;Whether it&amp;rsquo;s tariffs, tax credits, or regulatory changes, HPBA&amp;rsquo;s advocacy is focused on reducing uncertainty for our members. As temperatures drop and families prepare to embrace the cozy ambiance of their hearths, the&amp;nbsp;Hearth, Patio &amp;amp; Barbecue Association (HPBA)&amp;nbsp;is marking National Fireplace Month this October by reminding homeowners to make safety a top priority. The annual observance serves as a crucial reminder for fireplace, stove, and insert owners to take proactive steps to ensure their heating appliances are operating safely and efficiently.&amp;nbsp;

A fireplace is a cherished feature in many homes, providing warmth and a natural gathering point. However, without proper maintenance and safety practices, it can pose risks. A little preparation before the heating season begins can make all the difference.&amp;nbsp;&amp;nbsp;

&amp;ldquo;October is the perfect time to get ahead of the colder weather and prepare your fireplace or stove is ready for safe use,&amp;rdquo; said&amp;nbsp;President &amp;amp; CEO Jill McClure. &amp;ldquo;By taking a few simple steps now, homeowners can prevent common hazards and enjoy the full benefits of their fireplace all winter long.&amp;rdquo;&amp;nbsp;

HPBA offers the following eight essential safety tips for homeowners:&amp;nbsp;

1)&amp;nbsp;Schedule a Professional Inspection and Cleaning

The most critical step for any woodburning appliance is an annual inspection and cleaning by a certified professional. To find an NFI certified technician, visit&amp;nbsp;Homeowner Resources &amp;ndash; National Fireplace Institute (NFI).&amp;nbsp;This service removes creosote buildup, a highly flammable residue, and identifies any structural damage or obstructions in the chimney. Even gas and electric units should be inspected to ensure all components are functioning correctly.&amp;nbsp;

2)&amp;nbsp;Prepare for Service During the Off-Season

It&amp;rsquo;s best to have your hearth products serviced during the off-season. Most service companies and hearth shops recommend scheduling this essential maintenance between&amp;nbsp;April and August. By planning ahead during the warmer months, you can easily get ahead of the fall rush and ensure your fireplace, stove, or insert is safe, clean, and ready to keep you warm all winter.&amp;nbsp;

3)&amp;nbsp;Maintain a Safe Zone

Keep all flammable materials including furniture, curtains, rugs, and decorations at least three feet away from the fireplace or stove. This &amp;ldquo;circle of safety&amp;rdquo; helps prevent accidental ignition from sparks or intense heat.&amp;nbsp;

4)&amp;nbsp;Test and Maintain Alarms

Ensure all smoke and carbon monoxide (CO) detectors are in good working order. Test them monthly and replace batteries annually. Carbon monoxide is an odorless, colorless gas that can be produced by a faulty hearth system, making a working CO alarm essential for every home.&amp;nbsp;

5)&amp;nbsp;Use the Correct Fuel

For woodburning units, use only dry, well-seasoned wood. For wood fireplaces, manufactured logs (compressed sawdust) are a convenient, low-smoke option (but never use them in wood stoves). Avoid burning green wood, trash, plastic, cardboard, or treated wood, as these can create excessive smoke, dangerous fumes, and lead to creosote buildup.&amp;nbsp;

6)&amp;nbsp;Never Leave a Fire Unattended

Always supervise a fire when it is lit. Ensure the fire is completely extinguished before leaving the house or going to bed.&amp;nbsp;

7)&amp;nbsp;Use a Protective Screen

A sturdy fire screen or a set of closed glass doors is vital for containing sparks and embers, protecting floors and preventing burns, especially in homes with children or pets.&amp;nbsp;

8)&amp;nbsp;Practice Proper Ash Disposal

Shovel cooled ashes into a metal container with a tight-fitting lid. Place the container outdoors, away from any combustible materials, for at least 48 hours before final disposal. Ashes can retain heat for a surprisingly long time.&amp;nbsp;

HPBA encourages all homeowners to use National Fireplace Month as a prompt to review and implement these safety measures. By doing so, they can ensure their fireplace remains a source of warmth, comfort, and safety throughout the entire heating season.&amp;nbsp;

    <description>The Northeast States for Coordinated Air Use Management (NESCAUM) hosted a webinar on June 17 to provide an overview and update on their Independent Assessment of Residential Heating Appliances project. Funded by an $8.8 million grant from the EPA and working in conjunction with the National Residential Heating Task Force, the NESCAUM project has several primary objectives. One key goal is to rank the efficiency of certified stoves in the market and assess the role of certification data.

&amp;nbsp;

The Task Force includes representatives from state, local, and tribal agencies, including the Alaska Department of Environmental Conservation, the New York State Energy Research and Development Authority, and the Washington State Department of Ecology. It is important to note that of the 296 woodstoves currently on the EPA-certified list, the project will only test 150 stoves based on a selection criterion determined by Task Force members.

&amp;nbsp;

In addition to HPBA Government Affairs staff, several members of the Solid Fuel Hearth Appliance Section participated and submitted numerous live questions through the chat feature during the webinar. HPBA staff also provided a follow-up document with further questions for the record. Staff will continue to closely monitor this project and will provide updates as they are made available. The recent hurricanes that swept through the Southeast have left a devastating mark on many communities and several members of our association. As storms ravaged the region, homes were destroyed, infrastructures crippled, and families displaced. Among those deeply affected are employees of&amp;nbsp;Buck Stove, WNC Chimney Solutions LLC, and Wright&amp;#39;s Hearth, Heat, &amp;amp; Home, all of whom now face the long roads to recovery.

BUCK STOVE FACES HURRICANE HELENE&amp;#39;S DEVASTATION

Buck Stove, based in Spruce Pine, North Carolina, has been particularly hard hit. Hurricane Helene wreaked havoc on the community, causing widespread destruction. Many Buck Stove employees have lost nearly everything, with their homes and belongings destroyed. Fortunately, the plant experienced minimal harm, with some offices affected by roof damage.&amp;nbsp;&amp;nbsp;

Despite the challenges, progress is already being made. Satellite internet&amp;nbsp;has been set up to help families remain connected, and supplies, including essentials delivered via helicopter, have already begun to make a significant impact. Shelters are stocked, and there is optimism that electricity will be restored by this weekend, providing much-needed relief.

Although the plant is not fully operational, some shipments are going out. Though power restoration is expected soon, the complex damage in certain areas may delay full recovery for weeks.

&amp;ldquo;To show the spirit of these tremendous people, they have asked, &amp;lsquo;When will the plant be back up and running?&amp;rsquo; They want to go back to work if for nothing more than normalcy and security,&amp;rdquo; said&amp;nbsp;Paul Williams,&amp;nbsp;Sales Manager of Buck Stove. &amp;ldquo;Once power is restored and roads cleared, we can get things started. Again, everyone at&amp;nbsp;Buck&amp;nbsp;cannot say enough about all the support everyone has shown. The&amp;nbsp;Buck&amp;nbsp;brand has always been built with the security of family in mind. Now we can see how big that &amp;lsquo;Buck&amp;nbsp;Family&amp;rsquo; is.&amp;rdquo;&amp;nbsp;

ASHEVILLE AMONG MOST DEVASTATED CITIES

Immediate HPBA Past Chair&amp;nbsp;Dick Hoffman,&amp;nbsp;based in Asheville, North Carolina, suffered&amp;nbsp;significant damage to his warehouse, office, and garage buildings following severe flooding. Water levels in the warehouse reached 19 to 20 feet, leaving its contents covered in mud and debris, mostly unsalvageable.&amp;nbsp;

While Hoffman and his wife are safe, he reported widespread destruction across Asheville, where many areas still lack power, water, internet, and cell service. Fallen trees and downed utility lines have blocked streets, while overflowing creeks worsened the damage. Cleanup and restoration plans are underway.

Thankfully, the power has been restored. However, he expects it will take weeks to repair the municipal water system, which was heavily compromised. He also reported that the surrounding communities in western North Carolina have been devastated, with many residents stranded due to washed-out roads and bridges. Hoffman provided us with photos and said that they don&amp;rsquo;t truly portray the devastation.&amp;nbsp;

Wright&amp;rsquo;s Hearth, Heat, &amp;amp; Home, based&amp;nbsp;in Asheville, NC, sustained damage to an outdoor showroom after a tree fell during the hurricane, adding to the growing list of businesses affected by the storm. Though the physical damage was limited compared to other areas, the emotional and financial impacts are significant.&amp;nbsp;

WNC CHIMNEY SOLUTIONS LLC AREA HIT HARD

WNC Chimney Solutions LLC,&amp;nbsp;based in Waynesville, NC, has also been significantly impacted. One of its employees lost everything during the storm, leaving him with nothing but the clothes on his back. The hurricane has compounded the financial and emotional toll on employees and their families as they work to recover from the devastating losses.

REGIONAL FLOODING AND CONTINUED SUPPORT&amp;nbsp;
As the hurricanes passed, several areas, including Asheville, Busick, and Chimney Rock, experienced flooding. Power outages were widespread, but most have since been restored. However, road access remains difficult in some of the hardest-hit locations due to broken power lines, damaged poles, and failures in infrastructure and communication systems.&amp;nbsp;

Cindy Wise, Executive Director of the&amp;nbsp;Southeast HPBA, shared insight into the challenges faced by our members, &amp;ldquo;They are incredibly grateful for the individuals and organizations, such as HPBA, who are providing support and care to those affected.&amp;nbsp;We are truly blessed to have friends who take care of each other, especially after everything we&amp;#39;ve been through.&amp;quot;

HPBA ONGOING EFFORTS TO SUPPORT MEMBERS&amp;nbsp;

Though the road to recovery is long, the continued outpouring of support from the community is a beacon of hope for those impacted by these recent storms. As electricity is restored and aid efforts ramp up, there is growing optimism for a brighter future, though much work remains.&amp;nbsp;

HPBA has been actively contacting members in the affected areas to check their well-being. While some members were fortunate to avoid major damage, others face significant hurdles.&amp;nbsp;We are closely monitoring Hurricane Milton and will provide an update as we learn of any affected members.

The HPBA Member Employee Disaster Relief Fund was established to provide financial assistance to employees of HPBA member companies impacted by natural disasters, including hurricanes, floods, and wildfires. All contributions directly support member employees experiencing uninsured losses due to these catastrophic events. In 2021, the HPBA and HPBAC adopted StoveTeam International as a Charity of Choice. Since that time, with your support, StoveTeam International placed over 1,500 fuel-efficient cookstoves in homes in Central America. Their 1,000 Stove Challenge would not have been possible without the backing and generosity of companies like yours, Thank YOU!

Every cookstove we place is constructed and installed by trained and certified Master Stovebuilders. With these cookstoves, we are reducing the amount of fuel used by over 50%, reducing indoor smoke by nearly 100%, reducing carbon emissions by an estimated 80%, providing secure employment for local people, and reducing families&#39; reliance on open-fire cooking. One cookstove is a powerful and inexpensive solution that is making a difference in the lives of families.

In 2023, hearth industry retailers, distributors, and manufacturers have generously supported StoveTeam International&#39;s mission to reduce open-fire cooking in rural Central America. StoveTeam successfully raised $70,000 towards our $100,000 goal. The North Central Hearth, Patio &amp;amp; Barbecue Association (NCHPBA) announced exciting news that Karen Arpino is their new executive director for the North Central region. Arpino, with a background in the industry, brings a wealth of experience and a fresh perspective to the organization.
Arpino is also the Executive Director for the Northeast Region Hearth,&amp;nbsp;Patio &amp;amp; Barbecue Association, which includes the vibrant territories of New England and New York. She is a proud alumna of Purdue University, where she spent significant time in Wisconsin, Michigan, and Iowa during her college years.
She shared her excitement about visiting the Dakotas soon to immerse herself in the diverse landscapes and meet members from these beautiful states. Additionally, she has a specific item on her bucket list &amp;mdash; to savor a Bloody Mary at Sobelman&#39;s Bar in Wisconsin.

A bout of rain interrupted the cornhole tournament in the Outdoor Living area. However, the more than 220 outdoor dealers were undeterred and fired up their stoves. Socializing and dining on homemade grilled meats, smoked bacon, and outdoor-oven pizzas brought warmth to vendors and attendees despite the wet weather.




For those who preferred a dry evening, the NEHPBA offerings included an indoor display featuring 25 vendors of everything from hearth products to venting, savings programs, and insurance options. The event&amp;rsquo;s enormous success was due in no small part to the indoor and outdoor vendors who enthusiastically shared their wares and skills with the crowds.


The energizing Justin Bousquet of Napoleon brought additional excitement when he hosted the event&amp;rsquo;s auction. Rich Sedgwick took home the square raffle prize, a signed and framed Josh Allen NFL jersey.





Of course, the event was more than just fun and games. The featured presentation NESCAUM, NYSERDA, EPA: How Do They All Fit &amp;amp; What You Can Expect in Wood brought together a panel of experts including V.P. Berger of Hearth &amp;amp; Home Technologies, Chris Neufeld of Blaze King, Chris Schroeter of Napoleon, and Bret Watson of J&amp;oslash;tul. They discussed what evolving standards from these organizations mean for the HPBA industry and offered valuable guidance to manufacturers, vendors, and distributors.


In addition to the featured panel, Rich Sedgwick, Executive Director of the National Fireplace Institute, shared wisdom during his invaluable NFI Core and Gas Review courses. These opportunities, alongside tech education training and sweep education courses, attracted more than 65 participants. The &amp;ldquo;Send Your Tech&amp;rdquo; training was a crowd-pleaser that NEHPBA hopes to offer again at future events. Similarly well-attended were the five business roundtables, that offered strategic discussions on topics including health insurance options for small businesses, strategies for marketing and staffing businesses, and guidance around how to respond to gas ban legislation.


President &amp;amp; CEO of HPBA Jill McClure participated throughout the three-day event conversing with retailers, manufacturers, distributors, and vendors to learn more about how HPBA can best support industry stakeholders. McClure also hosted a fruitful discussion in the Outdoor Living area during her Monday Coffee &amp;amp; Mingle with the President event. The NEHPBA team is grateful to McClure for her dedication to the industry and her enthusiasm throughout the three days.


The event organizers thank all who participated, from sponsors and vendors to presenters and attendees. Next year&amp;rsquo;s &amp;ldquo;Stoke the Fire&amp;rdquo; event is scheduled for May 5-7, 2024, and promises to build on the flames sparked by this year&amp;rsquo;s impressive display.

    <title>Federal Court Rules AGAINST Berkeley&#39;s Gas Ban</title>

    <description>On Monday, April 17, 2023, a federal appeals court ruled against Berkeley, California&amp;rsquo;s ban on installing natural gas piping into new home construction. The decision from the U.S. District Court of Appeals for the Ninth Circuit came on an appeal in the California Restaurant Association vs. City of Berkeley. 
&amp;nbsp;
The case began when the city of Berkeley adopted a building code banning natural gas infrastructure in most new construction &amp;ndash; the first U.S. city to do so. While the city argued that the ban was merely on natural gas piping, not on natural gas itself, the three-judge panel unanimously agreed with the California Restaurant Association that the action was preempted by Department of Energy regulations on gas appliances.&amp;nbsp;&amp;nbsp;.&amp;nbsp;&amp;nbsp; 
&amp;nbsp;
In the opinion, Judge Patrick Bumatay penned that &amp;ldquo;by its plain text and structure, the [Energy Policy &amp;amp; Conservation] Act&amp;rsquo;s preemption provision encompasses building codes that regulate natural gas use by covered products. By preventing such appliances from using natural gas, the Berkeley building code did exactly that.&amp;rdquo; The decision reversed a District Court decision in favor of Berkeley and remanded the case for further proceedings.&amp;nbsp;&amp;nbsp; 
&amp;nbsp;
We anticipate there will be additional appeals, but this is a significant development that may impact other jurisdictions looking to curb natural gas use through building codes and other measures. HPBA &amp;ndash; along with the Air-Conditioning, Heating &amp;amp; Refrigeration Institute, the California Building Industries Association, the National Association Home Builders, and the National Association of Manufacturers &amp;ndash; filed an amicus brief in support of the California Restaurant Association.&amp;nbsp;

    <title>Women&#39;s Mentoring Program - Lessons Learned</title>

    <description>At the end of our HPBExpo &amp;rsquo;22 show in Atlanta, I was asked if I would like to lead the second round of our Women&amp;rsquo;s Mentoring Program. As someone who is young in her career and a mentee themselves, I was hesitant but excited to take a leadership role and gain such valuable experience. 
The Women&amp;rsquo;s Mentoring Program was initially developed by Rachel Feinstein, our former Senior Manager &amp;ndash; Government Affairs. She was a 10+ year veteran in the industry with a keen interest in women empowerment but moved onto a new job at a new company in early 2022. HPBA needed someone to take over the running of this program and turned to me. I knew that I had big shoes to fill, but I received great support from Rachel and our Director of Communications, Emily McGee, to take on such an important role. 
Here&amp;rsquo;s some insight into my experience in leading this program, my first professional experience taking the lead on a project of this magnitude.
From adolescence to adulthood, I participated in camps, leadership organizations, and community service initiatives, which has helped me understand the importance of networking and building relationships. So, for the second year of the program, my goal was for the participants to walk away with a new connection in the industry. With the help of HPBEF&amp;rsquo;s Director of Sales and Marketing, Amie Ryan, we paired the mentors and mentees based on their career aspirations, what they were seeking in a mentor/mentee, and other general interests.&amp;nbsp;
In addition, based on the feedback given from the first Women&amp;rsquo;s Mentoring Program in 2021, we provided more resources and engaging activities to help guide them during the program. To further meet those requests in that feedback, I provided a discussion topic and held a group call once a month. These new additions were designed to enhance their experience, drive conversations during the mentor and mentee calls, and provide shared experiences across our participants. &amp;nbsp;
As the program concluded and we received feedback, I considered the areas that need improvement and how to create a more valuable experience. These are important lessons learned for the next iteration of the program. 
Overall, we received positive feedback on the new additions and helpful suggestions to be applied for upcoming program years. I believe this program and other programs alike extend beyond establishing relationships with other women in the industry, but also can uplift and guide the next generation to keep our industry alive and adaptable.

    <title>Federal Gas Stove Ban?</title>

    <description>Reports abounded last week about the Consumer Product Safety Commission (CPSC) and &amp;ldquo;gas stoves&amp;rdquo; based on a letter from 20 legislators. Early reports indicated that an outright ban on gas ranges was on the table, but CPSC Chairman Alexander Hoehn-Saric has since clarified that there is no plan for the Commission to pursue a ban. The clarification comes after days of criticism from key legislators, including Sen. Joe Manchin (D-WV) and the Chair of the House Energy &amp;amp; Commerce Committee, Rep. Cathy McMorris-Rodgers (R-WA). A formal request for information is expected in March. President Biden&amp;rsquo;s staff also weighed in saying that &amp;ldquo;The President does not support banning gas stoves.&amp;rdquo; 
CPSC does, however, seem poised to consider some regulatory effort on gas cooking. While this effort targets gas ranges and not hearth products, it will certainly have wide-ranging implications. At a minimum, this is yet another step by state and federal decisionmakers to curtail &amp;ndash; and in some cases eliminate &amp;ndash; the use of gas-burning products. 
This letter from the Hill was partly a public response to several suspect studies on cooking and indoor air quality impacts &amp;ndash; pieces that have been touted by environmental advocates and some in the media without much oversight. With careful review of the &amp;ldquo;studies,&amp;rdquo; it becomes apparent what is being purported as settled science is anything but.
UCLA researchers in 2020 published a study that linked gas stoves to asthma. The study compared emissions at &amp;ldquo;peak concentrations&amp;rdquo; to average standards. The result was obviously skewed simply based on the uneven comparisons. Coincidently, using the same data when comparing against the same metric, the emissions were recorded well below established health standards. Unsurprisingly, this research was funded by the Sierra Club, an environmental activist group that is staunchly anti-fossil fuel. 
Similarly, a 2022 study published by Stanford warned that gas stoves not only cause health issues, but also contribute to global warming. A cursory reading of the study would show that the environment tested for the study encased the kitchen in plastic sheets and removed all sources of ventilation. This is clearly not an accurate representation of the average American kitchen. While surely not every home has a perfect ventilation system, no kitchens operate in a plastic sealed vacuum! 
Many of the studies claim that hazardous particulate matter in the air is a result of gas stoves. They ignore the fact that the vast majority of particulate matter released in the air comes from the food you are cooking. Even if you mandated electric stoves across the country, you wouldn&amp;rsquo;t be addressing the largest source of emissions in the kitchen: your food. 
What is most damning isn&amp;rsquo;t the unrealistic assumptions, fuzzy math, or tarped off kitchens: it&amp;rsquo;s what is deliberately ignored. The largest analysis of links between gas stoves and childhood asthma was published in the National Library of Medicine and funded by a British healthcare company. After the study that included over 500,000 children sampled worldwide, researchers found &amp;ldquo;no evidence of an association between the use of gas as a cooking fuel and either asthma symptoms or asthma diagnosis.&amp;rdquo;
With the evolving narrative of a polarizing issue, there is much to learn about how this process will play out. HPBA will be keeping a close eye on developments. The rulemaking &amp;ndash; which insiders indicate may even contemplate a ban on gas ranges &amp;ndash; is expected to take a year or more. HPBA will look for ways to take part in the public comment process as it opens. </description>

    <title>Passion &amp; Hard Work = Success</title>

    <description>As most of you know, our industry has been fighting attempts to force electrification in many states across the country.&amp;nbsp; During the 2022 Maryland General Assembly Session, we successfully pushed back on a very aggressive proposed ban on fossil fuels at the state level.&amp;nbsp; Despite this statewide decision, Montgomery County, MD introduced Bill 13-22 over the summer, again proposing a ban on fossil fuels at the county level.
When we heard that Montgomery County (MOCO) introduced a bill to ban fossil fuels, we went to work. We started calling our members within the county, along with other trade professionals (Chimney Professionals, MACA, Local 602 Pipe Fitters, HVAC, gas fitters, plumbers and manufactures of gas line, furnaces and hot water heaters) along with the CSIA and the NCSG. With the help of Corey Krill, HPBA&amp;rsquo;s Electrification Manager and Jonathan Williams, MAHPBA&amp;rsquo;s Executive Director, we sent out several action alerts, emails and letters.
How much did we affect the outcome? I can&amp;rsquo;t say for sure because small organizations can&amp;rsquo;t always track everything. And it was tough going &amp;ndash; we even thought about cutting our losses so we could live to fight another day. That was hard for me to hear &amp;ndash; they don&amp;rsquo;t call me &amp;ldquo;Mr. Maryland&amp;rdquo; for nothing! But I learned how politics are played. And yes, it can be played as a strategic game. And we kept going.
But without spending extra money by MAHBPA or HPBA, our passion kept us going and this hard work led to a great success. Our members, supporters, and friends sent 800 letters to the council. The version of Bill 13-22 that passed includes specific exemptions for gas fireplaces and outdoor grills!
This is all thanks to the work of the dedicated volunteers that comprise MAHPBA&amp;rsquo;s Government Affairs Committee, our Executive Director, the HPBA GA team and its electrification manager, and our coalition partners, Mid Atlantic Petroleum Distributors Association, the American Gas Association, and the Mid Atlantic Propane Gas Association, along with local gas suppliers. 
The story above should be the only reason you as a retailer, distributors or manufacturer, need to know why you should be members of HPBA and your local Affiliate. There are 12 Affiliates in the US and Canada with Executive Directors that guide a large group of industry volunteers to serve on the board and serve you as members. 
Our Government Affairs team is made up of our Executive Director, a director for each of the four states and the District of Columbia, several retail members, regional sale&amp;rsquo;s representative and the HPBA GA team as needed. 
As I let you go into the New Year, this was our story. I can assure you there are 11 other affiliates that are working with passion and hard work to bring you Success. </description>

    <title>Biomass Stove Tax Credit - Enacted!</title>

    <description>President Biden signed the Inflation Recovery Act (IRA) today and it contained the long-awaited (by us) tax credit for biomass stoves.
Why have we been promoting and lobbying for this for so long? Because replacing older stoves with a new, EPA-certified stove means cleaner air and a more efficient heating product. As a bonus, the tax credit will also make it easier to opt for a wood pellet stove. These are more complicated and more expensive than an EPA-certified woodstove. A tax credit will put clean pellet heat within reach of more people.
There are many areas of this country that depend on wood or pellets to heat their homes. And many people use a biomass heater as a backup for when the power goes out and they don&amp;rsquo;t have access to any gas options.
It&amp;rsquo;s easy to assume that electricity will always be available, especially when you are in a big city where outages are rare and short-lived annoyances. But in more rural areas, electricity is a wonderful convenience that isn&amp;rsquo;t quite as dependable. If this rural area is in a northern state and it is winter, it only makes sense to have a back up that can be fueled with biomass. (or even in Texas&amp;hellip;)
Starting in 1988, the EPA began to regulate wood stoves. In 2015, the EPA updated those regulations with an updated New Source Performance Standards. Anything sold after May 15, 2020 is producing a fraction of the emissions that you would see in that old wood stove in your grandparents&amp;rsquo; house. Every day that a homeowner is using an old stove instead of purchasing a new one, means unnecessary smoke in the air.
These technological marvels should be in every home that wants the convenience and reliability of biomass. Tax credits such as those signed into law today make these improvements more attainable for most families. We applaud the U.S. Congress and President Biden for including the biomass stove tax credit provisions within the IRA.</description>

    <description>With tax season upon us, some companies may be surprised to learn that they are eligible for a significant form of relief included in 2020 and 2021 COVID-19 relief packages: the Employee Retention Tax Credit (ERTC). While the Paycheck Protection Program (PPP) got a lot of attention in the media as support for keeping employees on the payroll, ERTC &amp;ndash; which can provide a payroll tax credit of up to $26,000 per employee &amp;ndash; may have been overlooked by some businesses. 
Background on ERTC
The ERTC was originally introduced in the March 2020 Coronavirus Aid, Relief, and Economic Security (CARES) Act, but was overshadowed by the more robust (and publicized) PPP offerings. This makes sense because in the early days, companies had to choose between ERTC and PPP. 






In December of 2020, the Consolidated Appropriations Act allowed all eligible employers to claim ERTC, even if they had already received a PPP loan. The one catch is that the ERTC cannot be claimed on wages that had been covered by a PPP loan. This meant that up to 50% of $10,000 in qualifying wages per employee could be claimed by many small businesses &amp;ndash; possibly a $5,000 per employee boost for 2020.


&amp;nbsp;ERTC really kicked into high gear, though, with the American Rescue Plan, increasing the amount a company could claim (increased from 50% to 70%) and extending availability of the tax credit through 2021 (although that was since reduced to only the first three quarters of 2021). Now, instead of up to $5,000 per employee per year, the maximum tax credit shot up to $7,000 per quarter for each eligible employee. With little fanfare, here is a phenomenal opportunity to claim a fully refundable tax credit for up to $26,000 per employee since the pandemic began.


&amp;nbsp;HPBA is not able to provide tax advice, so we recommend you speak with your payroll processor, accountant, or tax professional to see whether you may qualify for some or all of this credit. We will list some additional resources at the end of this piece.


Who Can Claim the ERTC?




&amp;nbsp;In order to be eligible for ERTC, you must be a business that has been impacted by COVID-19 by either a &amp;ldquo;Government Order&amp;rdquo; or by &amp;ldquo;Reduced Gross Receipts.&amp;rdquo; These can be determined by:


&amp;nbsp; &amp;bull;	A calendar quarter &amp;ldquo;in which the operation of the trade or business is fully or partially suspended during the calendar quarter due to an order from an appropriate government authority limiting commerce, travel or group meetings (for commercial, social, religious or other purposes) due to COVID-19.&amp;rdquo; This does not mean your business ever had to be completely shut down; even partially suspension of operation can qualify you for the tax credit.


&amp;nbsp;&amp;bull;	A calendar quarter with a substantial decline in gross receipts. For 2020, this was defined as a 50% reduction from the same quarter in 2019. For 2021, the reduction relative to 2019 was changed to 20%.


&amp;nbsp;Other factors that may affect or limit eligibility include:
&amp;bull;	The small business status of a company
&amp;bull;	Sole proprietorship
&amp;bull;	Wages of related individuals


&amp;nbsp;Again, a tax advisor will help you navigate most eligibility issues.


&amp;nbsp;What Wages are Eligible for the Credit?




&amp;nbsp;All wages and health insurance benefits paid in a qualifying time period (and not covered in a PPP loan or other relief offering) can count as eligible wages. For 2020, the covered period is from March 13th &amp;ndash; December 31st. For 2021, the three eligible quarters are January 1st &amp;ndash; March 31st, April 1st &amp;ndash; June 30th, and July 1st &amp;ndash; September 30th. Just because an employer qualifies in one year or one quarter does not mean they will automatically qualify in both years or all quarters.


How Do You Calculate the Tax Credit?
For 2020, the maximum credit is $5,000 per employee for the entire year. Qualifying wages of up to $10,000 are eligible for a 50% credit. 




$10,000 x 50% = $5000 (per employee)


For 2021, the maximum credit is $7,000 per quarter per employee. Since the ERTC only ran through September 30, 2021, this means a maximum of up to $21,000 per employee for the year.
$10,000 x 70% = $7,000 (per employee per quarter)


Note: if an employee did not have $10,000 in qualifying wages per quarter, the claimable tax credit would be reduced accordingly.


How is the Tax Credit Claimed?
The credit can be claimed on Form 941. If you need to amend a claim for 2020 or for one or more quarters of 2021, you may use Form 941-X.


The IRS, National Federation of Independent Business, payroll processors, tax preparers, and other trade associations may all have additional resources for you to review as you determine eligibility and as you look to file a claim. If you have questions, please reach out to Ryan Carroll.
